Borthakur, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Special (NDPS) Case No.33/2026, under Section Page No.# 2/2 20(b)(ii)(B) of the NDPS Act, 1985 arising out of Sorbhog P.S. Case No.33/2026, pending in the Court of the learned Additional Sessions Judge cum Special Judge (FTC), Barpeta. 3. 1.930 Kg of ganja was recovered from the possession of the present petitioner. The petitioner is aged about 26 years old. The Charge-Sheet has been filed with the stipulated period of time. The petitioner has already spent more than 60 days in judicial custody. The charge is yet to be framed. 4. Considering the aforesaid facts, this Court is of the opinion that the petitioner no longer deserves to be detained in custody. Therefore, his bail application is allowed. 5. The petitioner, Dharmendra Nath, who is facing trial before the Court of the learned Additional Sessions Judge cum Special Judge (FTC), Barpeta in Special (NDPS) Case No.33/2026 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Special Judge (FTC), Barpeta. 6. The petitioner is directed to regularly appear before the Trial Court on each and every date of hearing. If he fails to do so, the Trial Court shall have the liberty to procure his attendance by due process of law. 7. With the aforesaid direction, this bail application stands disposed of.
