The Court made the following Order:-
The petitioner is aggrieved by the inaction on the part of the respondent No.2 in considering the representations of the petitioner dated 02.08.2021 and 26.08.2021, whereby the petitioner brought to the notice of respondent No.2 that respondent No.3 was undertaking unauthorised construction in Layout No.44/98. The petitioner seeks a direction to respondent No.2 to consider the said representations and pass appropriate orders. 2. The learned Standing Counsel appearing for respondent No.2 submits that detailed counter is filed stating that a provisional notice dated 10.10.2021 was issued to respondent No.3. It is also submitted that respondent No.3 had applied online through APDPMS website by submitting the vacant land tax receipt, title documents and other relevant documents, along with an encumbrance certificate and undertaking, as required under the applicable Municipal law. 3. It is further submitted that the title dispute between the petitioner and respondent No.3 is the subject matter of proceedings before this Court and that the petitioner had earlier filed W.P.No.12201 of 2021 challenging the registration of the sale deed in favour of respondent No.3. The petitioner had also submitted representations, which were not considered by the respondents therein. Accordingly, the said writ petition was disposed of, directing the respondents to pass appropriate orders on the representations of the petitioner. 4
4. The 2nd respondent is not competent to adjudicate upon the title dispute between the petitioner and respondent No.3. If the parties have any dispute with regard to title, they are at liberty to invoke the jurisdiction of the appropriate forum. 5. In view of the above submissions, the writ petition is disposed of, directing respondent No.2 to consider and dispose of the representation of the petitioner, in accordance with law, after affording an opportunity of hearing to all the parties concerned.
