According to petitioners, their shops were open from two sides, however Mandi Samiti is now closing one side by constructing shop, next to their shops. This, according to petitioners, is illegal as Mandi Samiti cannot remove the organic waste converter for constructing shop. (3) Mr. Vipul Sharma, learned Counsel for the Mandi Samiti, however submits that there is road on both sides of petitioners’ shops, however there is a wall erected on one side as per original lay out and petitioners removed that wall without permission. He further submits that there is no pleading to the effect that there was organic waste converter, next to petitioners’ shops. (4) Learned Counsel for the petitioners submits that petitioners have already made a representation. Representation, however, is addressed to District Magistrate and not to Managing Director. (5) Writ petition is, accordingly, disposed of with liberty to petitioners to make representation to Managing Director. If petitioners make representation within ten days from today, decision thereupon shall be taken, as per law, within three weeks thereafter.
