BEFORE HONOURABLE MRS. JUSTICE YARENJUNGLA LONGKUMER ORDER 17/06/2026 The instant application under Section 24 R/W Section 151 of the CPC has been filed by the petitioner praying for transfer of the Case No. T.S(D) No.63/2024 pending before the District, Judge, Morigaon, Assam to the Court of
Page No.# 2/3 Principal Judge, Family Court at Guwahati. 2. Heard Mr. M. Kalita, learned counsel for the petitioner. As well as Mr. G. Kakoti, learned counsel for the respondent. 3. The case of the petitioner is that the petitioner and the respondent were married on 04.03.2016 at the residence of the respondent in Morigaon, Assam, and after marriage, they lived as husband and wife at the residence of the respondent. 4. Thereafter, after a few months of marriage, the petitioner got pregnant and since that time there arose some difference of opinion between the parties. On 11.02.2017, the petitioner gave birth to a female child who is now about 7(seven) years old and studying in class-1 at Kendriya Vidyalaya, Narengi, Guwahati, and living with the petitioner at Guwahati. 5. It is stated that since, 14.02.2017 the petitioner and her minor daughter have been staying with the widowed mother at their parental home at Guwahati. 6. The petitioner states that the respondent belongs to a well to do family having landed property and he himself is a government employee. 7. Subsequently, the respondent has filed a case before the District, Judge, Morigaon, Assam, against the petitioner for dissolution of marriage and for a decree of divorce, which has been registered and numbered as T.S(D) No.63/2024 and the Notice in the said case has been received by the petitioner.
It is stated that the petitioner is living with her widowed mother who is suffering from several ailments and it is difficult for her to leave her mother and her
Page No.# 3/3 daughter to contest the case at Morigaon and moreover, being a single mother she also has the added responsibility of dropping her minor daughter to school and picking her up and for which it is impossible for her to appear before the District, Judge, at Morigaon. It is therefore prayed that in the interest of justice the T.S(D) No.63/2024 may be transferred to the court of the Family Judge, Family Court Kamrup(M), at Guwahati. 8. The learned counsel for the respondent has no objections in the instant petition. Accordingly, the petition is allowed. And the T.S(D) No.63/2024 pending before the District Judge, Morigaon is transferred to the court of Principal Judge, Family Court at Guwahati. 9. The District Judge, Morigaon, is directed to transfer the records of the T.S(D) No.63/2024 to the Court of Principal Judge, Family Court at Guwahati forthwith. 10. The parties are directed to appear before the Principal Judge, Family Court, Guwahati, on 6th August, 2026. 11. The Registry is also directed to transmit a copy of this order to the District Judge, Morigaon, Assam. 12. Petition stands disposed. JUDGE Comparing Assistant
