The petitioner has filed this Writ Petition ( C ) under Articles 226/227 of the Constitution of India assailing the whole proceeding initiated by respondent No.3 Nayab Tahsildar, Tehsil Bamnihdih, District Janjgir Champa on the application filed under Section 250 read with Section 32 of the Chhattisgarh Land & Revenue Code, made by respondent No.4, whereby stay order dated 7-6-2024 in Revenue Case No.202411962400015 titled as (Rameshwar 2 Prasad Vs. Salikram) was issued against the petitioner restraining him from tampering with the soil and any further construction work on his own land without calling mandatory site inspection report by Patwari. 2. In pursuance of the direction given by this Court, Mr. Chandra Kumar Sahu, Nayab Tahsildar, Bamnihdih, District Janjgir Champa has appeared before this Court through video conferencing and would submit that against the order dated 25-7-2025 passed by the Tahsildar, Bamnihdih the present petitioner had preferred revision under Section 50 of the Land Revenue Code 1959 which was disposed of on 12-11-2025 wherein the Additional Collector, District Janjgir – Champa has rejected the same and now the matter is fixed before the Tahsildar, Bamnihdih on 7-1-2026 for further hearing. 3. Considering all the aspects of the matter, it is directed that let the Tahsildar, Bamnihdih conclude the proceeding of demarcation within 45 days from the date of the order passed by this Court so that the land of the petitioner, which is according to him bearing Khasra No. 2361/19 is identified and if it is found that no proceeding is required to continue against the land of the petitioner, the Tahsildar, Bamnihdih will drop the proceeding against the petitioner’s land and the other persons who have encroached or violated any provisions of law, the Tahsildar Bamnihdih shall be at liberty to proceed against them, in accordance with law. It is also directed that neither the petitioner nor the private respondent shall adopt any delay tactics and even the Tashildar, Bamnihdih to ensure that the order passed by this Court is complied with within the stipulated time given by this Court, in its letter and spirit. 4. With the aforesaid observation and direction, this writ petition is disposed of. 5. Pending interlocutory applications, if any, also stand disposed of.
