Chatterjee, APP …...... 02 /26.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 317(5)/318(4)/338/336(3)/340(2)/61 of the Bharatiya Nyaya Sanhita and Sections 30(ii) of the Coal Mines Act. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. The allegation in the First Information Report (FIR) is that a truck was transporting illegally mined coal on forged documents. The driver produced the documents when the vehicle was apprehended and stated that these documents were handed over by this petitioner. Solely on the statement of the driver and finding that there are calls between this petitioner and the driver, this petitioner has been implicated in this case. This petitioner was not apprehended on the spot and there is no other material except what has been mentioned above and the chargesheet has not been submitted. 5. Considering the fact that aforesaid is the only material against the petitioner, I am inclined to grant bail to the petitioner. 2026:JHHC:5684 2 Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Ramgarh in connection with Patratu PS Case No. 273 of 2024 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand. 6.
