The petitioners are apprehending their arrest in connection with Gola P.S. Case No. 96 of 2024 registered under sections 406, 409, 420, 468, 379 and 34 of I.P.C. pending in the Court of learned J.M. Ist Class, Ramgarh. 3. Learned counsel for the petitioners submits that petitioners are innocent and they have been falsely implicated in this case. He next submits that allegation is levelled against Raj Kumar Choudhary regarding non payment of money and making wrongful gain by causing financial loss and damages and that allegation is not against the petitioners. He next submits that there is general and omnibus allegation. He further submits that entire allegation is based on surmises and conjectures. Lastly, he submits that arbitration proceeding is going on pursuant to order passed in Arbitration Application No. 19/2024. He next submits that main accused Raj Kumar Choudhary has been granted anticipatory bail in A.B.A. No. 3252 of 2025. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. ( 2026:JHHC:13179 ) 4. Learned counsel for the State opposes the prayer and submits that allegations are there of taking the possession of the company and not utilizing the same and not paying the dues. 5. In view of above and in the light of materials available on record, prima facie it appears that allegation revolves around civil dispute of business transaction and agreement. There is breach of contract and financial dispute. There are reference of several agreements in the complaint. The co-accused has been granted anticipatory bail in the aforesaid A.B.A. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Ramgarh, in connection with Gola P.S.
