GUNESHWAR SHARMA ORDER 31.08.2026 [1] Heard Mr. M. Chittaranjan, learned counsel for the petitioner and Mr. S. Chittaranjan, learned Addl. AG cum Special PP assisted by Mr. A. Priyokumar Sharma, learned counsel on behalf of the State respondent. [2] Bail application no. 19 of 2026 is pending before this Court and petitioner was released on interim bail by order dated 11.08.2026 so as to enable him to appear in the 2nd Semester of Graduation Examination conducted by Manipur University (MU). The petitioner has to surrender today i.e. 31.08.2026 in terms of the earlier order, however, during the meantime, the petitioner has filed an application being MC (Bail Appln.) No. 19 of 2026 praying for extension of the interim bail for a further period of 15(fifteen) days from 31.08.2026 to 15.09.2026 and exempt from surrendering today i.e. 31.08.2026. [3] Learned counsel for the petitioner draws the attention of this Court to the notice dated 27.08.2026 issued by Controller of Examination, MU, fixing the date for practical examination for some of the subjects from 7th to 10th September, 2026 and given liberty to the respective Colleges for completing the practical examination from 2nd to 20th September, 2026. As per the notice dated 27.08.2026 issued by Controller of Examination, MU, for Botany subject, the Oinam Thoib a Meitei Digitally signed by Oinam Thoiba Meitei Date: 2026.08.31 16:18:07 +05'30' Colleges have been given liberty to fix a schedule from 2nd September, 2026 and complete the whole process of the practical examination and submission of the marks to the MU by 20th September, 2026. It is submitted that Thambal Marik College is yet to issue time table for the practical examination of Botany subject and the same is expected very soon. If the petitioner surrenders today and taken into custody, he has to approach this Court for another interim bail for appearing in the practical examination. In order to avoid repeated application and to keep him some time to study and prepare for the practical examination, it is submitted that the interim bail may be extended as prayed for. [4] Mr. S. Chittaranjan, learned Special PP submits that the time table is not fixed for the practical examination of Thambal Marik College and the petitioner has to surrender in terms of the earlier order and when time table is fixed by the College, he may approach this Court again. [5] This Court has perused the materials on record. In terms of the notice dated 27.08.2026, the practical examination schedule has been issued by the University for some subjects starting from 2nd to 10th September, 2026. However, for other subjects including Botany, liberty to the respective Colleges has been given to schedule the practical examination from 2nd September, 2026 and complete the whole process of the practical examination and marks to be submitted by 20th September, 2026 to the MU. [6] This Court is of the view that in order to avoid filing of similar application within few days, the interim bail is extended till 20.09.2026 on the same conditions of earlier interim bail order dated 11.08.2026 and provides that if the last practical examination end a day prior to 20.09.2026, the petitioner shall surrender to the Superintendent, Manipur Central Jail, Sajiwa on the next day of the end of practical examination. [7] With these observations, MC (Bail Appln.) No. 19 of 2026 is disposed of. [8] List the main bail application on 21.09.2026. [9] Registry is directed to furnish a copy of this order to the learned counsel appearing for the parties by whatsapp or any other available mode. JUDGE Thoiba
