This petition under Section 482 BNSS, is filed for granting the privilege of pre-arrest bail to the petitioner, namely, Biswaraj Das apprehending his arrest in connection with Dibrugarh P.S. Case No. 224/2025 registered u/s 117(2)/109 of BNS, 2023. 4. The allegation in the FIR dated 05.07.2025 lodged by one Biplab Biswas is that his brother Amit Biswas was left in an unconscious stage after being assaulted. Mention has been made of one vehicle bearing registration No. XXXX- X09333. It is alleged that the unnamed attacker came out of the vehicle and assaulted kicks and blows which led to injury and subsequent hospitalization of his brother. One girl named as Nabamita Sarkar is also stated to be in the vehicle and instigated the act. The present petitioner is not named in the FIR. 5. Scanned TCR as called for is received. 6. Subsequent to the grant of interim, the petitioner appeared before the IO and his statement has been recorded. 7. Mr. K. Baishya, learned Additional PP submits that in the meantime, investigation stands completed, resulting in chargesheet and subsequently, the case has proceeded as charges have also been framed on 25.02.2026, and the case is at the stage of evidence. 8. In the given facts and circumstances, the interim bail granted on 04.08.2025 is hereby made absolute, subject to the following conditions that :- (i) He shall be available for the remaining trial; (ii) He shall not hamper or tamper with the evidence.
