(3) Learned State Counsel points out that the suit was dismissed by the Trial Court on 16.7.2010; petitioner preferred appeal, which was allowed by Additional Commissioner, Kumaon Division, vide judgment dated 28.6.2016 and the matter was remanded back to the Trial Court. (4) Since the suit was reportedly filed in 1986 and 40 years have gone by after filing of the suit, therefore, writ petition is disposed of with a direction to Assistant Collector, 1st Class, Haldwani to decide the suit within nine months from the date of presentation of certified copy of this order.
