Heard learned counsel for the parties.

The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Sections 115(2), 126(2), 127(2), 191(3), 303(2), 118(2), 109(1), 324(6), 352 of Bharatiya Nyaya Sanhita, 2023 in connection with Barhi PS Case No. 287 of 2025.

Learned counsel for the petitioners submits that the petitioners and the alleged victim have previous land dispute and for this reason only the petitioners have been implicated in the present case. He further submits

that there is a case and counter case between the parties. He further submits that petitioners, namely, Vinod Yadav and Ajay Yadav are in jail custody since 08.08.2025 and the petitioner, namely, Vikash Yadav is in jail custody since 04.08.2025 and they are not having criminal antecedent. As such, he submits that the petitioners may be enlarged on bail.

Learned counsel for the informant vehemently opposes the prayer for bail of the petitioners and submits that statement of the injured was recorded wherein he supported the allegation as alleged against the petitioners herein.

Learned APP also opposes the prayer for bail of the petitioners.

Having regard to the facts of the case and looking to the allegation made against the petitioners coupled with the fact that there is a case and counter case between the both the parties and it relates to land dispute and the petitioners are in custody since 08.08.2025 and 04.08.2025, I am inclined to enlarge the petitioners, namely, Vinod Yadav in B.A No. 11295 of 2025, Vikash Yadav @ Vikash Kumar Yadav in B.A No. 11302 of 2025 and Ajay Yadav in B.A No. 11305 of 2025 on bail. Accordingly, the petitioners, above-named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Hazaribag in connection with Barhi PS Case No. 287 of 2025.

It is made clear that the petitioners shall appear on each and every date before the learned trial Court and they shall not threaten any witnesses and shall co-operate in trial and if any adverse report will come against the above-named petitioners, learned trial Court shall be at liberty to cancel the bail of the above-named petitioners.

Accordingly, all these bail applications stand allowed.
