Heard Mr. Fahad Allam, learned counsel appearing on behalf of the opposite party- State of Jharkhand. 3. Learned counsel for the petitioner submits that the petitioner is in custody since 15.09.2025 in connection with Pakur (T) P.S. Case No. 159 of 2005 corresponding to G.R. Case No. 410 of 2005, registered under Section 395 of I.P.C., now pending in the court of learned Pr. Session Judge, Pakur. 4. Learned counsel for the petitioner further submits that the co- accused, who faced the trial, has been acquitted and in the trial of the co-accused, most of the witnesses turned hostile. So far as the petitioner is concerned, he was on bail since 30.11.2005 and his bail bond was cancelled on 07.11.2006 and ultimately he was arrested and remanded vide order dated 15.09.2025. 5. The learned counsel further submits that considering the fact that the co-accused has been acquitted, the petitioner may be enlarged on bail. 6. The learned counsel for the State has opposed the prayer for bail. 7. After hearing the learned counsel for the parties, this Court is of the view that the petitioner cannot take any advantage of the acquittal of the co-accused. The petitioner has absconded after grant of bail for a pretty long time and has been ultimately arrested. Accordingly, this ( 2026:JHHC:5886 ) 2 Court is not inclined to enlarge the petitioner on bail and hence, this bail application is rejected. 8.
