JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Diwakar Jha, Advocate For the State :- Mr. Satish Kumar Keshri, A.P.P. ---- 02/05.02.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Jainagar P.S. Case No.123 of 2025, for the alleged offences registered under Sections 126(2), 115(2), 308(2), 190, 191(2), 191(3), 303(2), 324(2), 352, 351(2) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned S.D.J.M., Koderma. 3. Learned counsel for the petitioner submits that the land of the petitioner was acquired and compensation was not made and in view of that petitioner was agitating and for that false case has been registered against the petitioner on the instigation of MLA, Barhi. He further submits that there are another three cases being Jainagar P.S. Case No. 119/2025, 120/2025 and 123/2025 has been lodged for the similar allegation. He further submits that petitioner has got no criminal antecedent as disclosed in paragraph-18 of the petition except as stated. He then submits that it is not believable that petitioner will do same act continuously and for that three cases have been lodged ( 2026:JHHC:3230 ) --2-- against the petitioner. He next submits that in identical situation three co-accused persons have already been granted anticipatory bail in A.B.A. No. 7182 of 2025. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits that allegations of extortion and assault are there. 5. In para 9 of the petition it has been disclosed for the same type of allegation another three cases have been lodged being Jainagar P.S. Case No. 119/2025, 120/2025 and 123/2025 on the instigation of MLA, Barhi and it has been pointed out that land of the petitioner was acquired and compensation was not paid for that petitioner was agitating and in identical situation, the co-accused persons have already been granted anticipatory bail in A.B.A. No. 7182 of 2025. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Koderma in connection with Jainagar P.S. Case No.123 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
