Call for the relevant records, Quash the First Information Report in Crime No.99/2025 registered by the Lingadahalli Police, against the petitioner for the offences punishable under Sections 329(4), 74, 115(2),76, 352, 351(2) of the BNS pending on the file of I ADDL. Civil Judge and J.M.F.C Tarikere, Chikkamagalur District. b. Grant such other relief or reliefs as this Hon'ble Court deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity." 2. Heard Sri.Chetan Desai, learned counsel appearing for the petitioner, Sri. Channappa Earappa, learned HCGP appearing for respondent No.1, Sri. Sheshadri Gowda.T.G, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a joint affidavit. The joint affidavit reads as follows: - 3 - HC-KAR NC: 2026:KHC:14654 CRL.P No. 3572 of 2026 "JOINT AFFIDAVIT We, (1) SRI R SATHYAPPA, son of Ramanaik aged about 60 years Residing at Nandibatalu Colony, Lingadahalli Hobli, Tarikeri Taluk, Chikkamangaluru-577228 (2) Smt. USHA, W/o Thyavarenaik, residing at varathegundi village, nandhibattalu post, lingadahalli hobli, tarikere taluk, Chikamangaluru District Pin-560054, the deponents herein today at Bengaluru, do hereby solemnly affirm and state on oath as follows. 1. We state that, the deponent no.1 had initiated criminal case in Crime No.99/2025 before the lingadahalli police station, for the offences punishable under section 329 (4), 74, 115 (2), 76, 352, 351 (2) of the BNS presently pending on the file of Ist AddL Civil Judge and JMFC Tarikere, Chikkamagaluru District and the same was filed by the deponent No.1 under misconception. 2. We state that, all the above deponents at the intervention of elders and well wishers of both the families have amicably settled our differences and living together. 3. We state that, the deponent No.1 has agreed to co-operate in quashing the proceedings in Crime No.99/2025 before the Lingadahalli police station, for the offences punishable under section 329 (4), 74, 115 (2), 76, 352, 351 (2) of the BNS presently pending on the file of Ist AddL Civil Judge and JMFC Tarikere, Chikkamagaluru District. 4. We state that, there is no coercion or undue influence in filing the present affidavit and we are filing this affidavit with our free consent. The parties to the lis are present before this Court and are identified by their respective counsels. 5. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint affidavit and close the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.99/2025 pending before the I Addl.
