Mr. G.D. Joshi, Advocate, for the petitioner. Mr. Ananya Thapliyal, Central Govt. Standing Counsel, for the Union of India. (2) Petitioner was employed with Ordnance Factory, Raipur, Dehradun as Durwan. He was compulsorily retired vide order dated 16.8.2022. Petitioner has challenged the order of compulsory retirement by filing Original Application before the Central Administrative Tribunal, Nainital, which is numbered as OA No. 646 of 2026. Said Original Application is said to be pending. Petitioner has approached this Court challenging a notice, issued to him on 30.6.2026 by Estate Officer, India Optel Ltd. By the said notice, petitioner has been called upon to deposit ₹80,467 as penal rent for unauthorisedly occupying the official accommodation provided to him. Petitioner has also been asked to vacate the accommodation within seven days, failing which proceedings for eviction would be initiated against him. (3) Learned Counsel for the respondents submits that petitioner has filed Original Application, which is pending, therefore this relief could have been sought UKHC010118782026 2026:UHC:6115 by the petitioner before the Tribunal. (4) Learned Counsel for the petitioner, however, submits that the quorum for learned Tribunal is not complete, therefore cases are not being taken up. He submits that petitioner be given protection for a limited period to enable him to move the Tribunal for appropriate relief. (5) Writ petition is, accordingly, disposed of by permitting the petitioner to move appropriate application for relief before the Tribunal. For a period of two months, effect of the impugned notice shall remain suspended.
