1. Both the applications have been filed under Sections 483 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in connection with Bishunpur P.S. Case No.16 of 2025 registered under Section 309(4)/115(2) of B.N.S. pending in the court of learned Judicial Magistrate, 1st Class, Gumla.
2. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case on the basis of confessional statement of co- accused, Harinandan Kumar. But the said Harinandan Kumar has been granted bail by the co-ordinate Bench of this Court vide order dated 10.11.2025 in B.A. No. 8279 of 2025.

It has been submitted that the other co-accused persons, namely, Chandar Saw @ Guddu, Shubham Kumar Mehta and Harinandan Kumar have been granted bail by the Co-ordinate Bench of this Court in B.A. Nos. 9717 of 2025, B.A. No. 10360 of 2025 and B.A. No. 8279 of 2025 vide order dated 05.12.2025, 01.12.2025 and 10.11.2025 respectively.
4. Learned counsel for the petitioners, on the aforesaid ground, has submitted the petitioners may also be enlarged on bail.
5. Learned Additional Public Prosecutors appearing for the opposite party-State in both the cases although have seriously opposed the prayer for grant of bail but they have not disputed the fact of grant of bail in favour of the co- accused persons.
6. This Court has heard the learned counsel for the parties.
7. This Court has taken into consideration the fact that the other co-accused persons, namely, Chandar Saw @ Guddu, Shubham Kumar Mehta and Harinandan Kumar have been granted bail by the Co-ordinate Bench of this Court in B.A. Nos. 9717 of 2025, B.A. No. 10360 of 2025 and B.A. No. 8279 of 2025 vide order dated 05.12.2025, 01.12.2025 and 10.11.2025 respectively, this Court is of the view that the present applications deserve to be allowed.
8. Accordingly, both bail application stand allowed.
9. In consequence thereof, the petitioners named above, are
directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Judicial

Magistrate, 1st Class, Gumla in connection Bishunpur P.S. Case No. 16 of 2025 with the condition that the petitioners shall co-operate in the trial and shall not absent themselves on the date fixed without any cogent cause. In failure, the learned trial court shall have liberty to pass appropriate order in accordance with law so that the trial be not hindered.
