1. Mr. Alok Kumar, learned counsel for the applicant.
2. By the instant petition, the applicant is challenging the proceeding of Complaint Case No. 4535 of 2023, Ram Bhajan vs. Pankaj Kashyap, which is a proceeding under Section 138 of the Negotiable Instruments Act.
3. It is submitted by the learned counsel for the applicant that the applicant is ready to face the trial court proceeding, however, since, non bailable warrants have been issued the same may be kept in abeyance subject to this condition that the applicant shall ensure his presence before the Trial Court on the next date fixed.
4. After hearing the submission of the
learned counsel for the applicant and taking into consideration that the applicant is ready to face the trial court proceeding, the non bailable warrants issued against him shall remain in abeyance subject to the condition that the applicant shall ensure his presence before the Trial Court on the next date fixed. It is made clear that if the applicant fails to ensure his presence before the Trial Court on the next date fixed, the non bailable warrants issued against him shall automatically revive.
5. Subject to the observation and direction as above, the instant C528 petition is disposed of finally.
