For the State : Mr. Arup Kumar Dey, A.P.P. ----- 03/ 25.02.2026 The petitioner is seeking regular bail, in connection with Gandey P.S. Case No. 52 of 2025, registered for the offence under Section 103(1) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Giridih. 2. Learned counsel appearing for the petitioner submits that the petitioner happened to be the husband of the deceased. He next submits that the petitioner was working outside the State of Jharkhand. He also submits that the wife of the petitioner has committed suicide for that the petitioner has been implicated in this case. He then submits that the petitioner is in custody since 27.09.2025. He also submits that the mother-in-law of the deceased has already been provided the privilege of anticipatory bail in A.B.A. No. 524 of 2026 by this court. 3. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner happened to be the husband of the deceased. 4. Considering that the wife of the petitioner has committed suicide and petitioner is in custody since 27.09.2025 and the mother-in- law of the deceased has already been provided the privilege of anticipatory bail in A.B.A. No. 524 of 2026 by this court, I am inclined [2026:JHHC:5482] -2- to release the petitioner, on regular bail. 5. Accordingly, the petitioner, named above, is directed to be released on regular bail, on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Giridih, in connection with Gandey P.S.
