JUSTICE M.I.ARUN - 3 - HC-KAR NC: 2026:KHC:13029 WP No. 3378 of 2026 ORAL ORDER The petitioner has challenged the action initiated by the respondents on the allegation that the petitioner has put up illegal construction in violation of building by-laws in the sanctioned plan. 2. The case of the petitioner is that he has not put up any construction in violation of the alleged sanctioned plan. 3. Per contra, the learned counsel for the respondents submits that the building constructed by the petitioner is in violation of the sanctioned plan. However, he fairly submits that in the light of the amended Zonal Regulations of the Revised Master Plan 2015 for Bengaluru and Greater Bengaluru (Amendment) Regulations, 2025, the petitioner may be given an opportunity to submit a detailed explanation as to why his building should not be demolished and the jurisdictional Joint Commissioner - 4 - HC-KAR NC: 2026:KHC:13029 WP No. 3378 of 2026 would thereafter pass appropriate orders in accordance with law. 4. His submission is placed on record and the following order is passed: ORDER i. The Writ Petition is hereby disposed of. ii. The petitioner shall appear before the jurisdictional Joint Commissioner on 17.03.2026 at 11.00 a.m. and submit a detailed representation, along with all the necessary documents, to justify the construction put up by him. iii. The jurisdictional Joint Commissioner shall consider the representation submitted by the petitioner and thereafter pass appropriate orders in accordance with law. - 5 - HC-KAR NC: 2026:KHC:13029 WP No. 3378 of 2026 iv.
