NATARAJ ORAL ORDER The petitioners have challenged the initiation of criminal proceedings in Crime No.127/2023 by the respondent No.1 for the offences punishable under Sections 498A, 354A, 504, 506 read with Section 149 of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. When this petition is listed for preliminary hearing in ‘B’ group, the petitioner No.1 on his behalf and on behalf of petitioner Nos.2 to 7, and respondent No.2 have filed a joint affidavit in terms of which, the petitioners and the respondent No.2 have settled their differences and respondent No.2 has accepted that the criminal proceedings initiated against the petitioners in Crime No.127/2023 registered by the respondent No.1 against the petitioners be quashed. The joint affidavit reads as follows: - 4 - HC-KAR NC: 2026:KHC:16070 WP No. 22003 of 2023 “We, 1) Dhavalkumar H Ratanpura, S/o Hargovindbhai, Aged about: 33 years, R/at A-74, Akshatam Saptam, Ahamadabad High Way, Palaya- 385001, and (2.) Smt. Savitha, D/o Vagh Singh, Aged about: 30 years, R/at No.4397/1, 9th Cross, St. Marrys Road, N.R.Mohalla, Mysuru-570007, today Bangalore., do hereby solemnly affirm and state on oath as follows: 1. We stated that the first of us is the petitioner No.1 in this case and 2nd of us is respondent No.2 in this case and we are conversant with the facts of the case, the first of us is swearing to this affidavit on his behalf and also on behalf of petitioners No.2 to 7of having so authorized. 2. We were the husband and wife and our marriage is dissolved by the Judgment dated: 5-3-2016 passed by the 1st Addl. Prl. Civil Judge, family Court at Mysuru. 3. We stated that at the instance of the 2nd of us FIR was registered by Mysuru City Women's Police station at Mysore against the first of us and his parents, siblings and brother in law/petitioners No.2 to 7 in Crime No. 127/2023 for the offence punishable under section 498A, 354A, 504, 506 R/w 149/ of IPC and 3 and 4 of D.P. Act. 4. We state that all the accused persons including the first of us herein have preferred the present petition seeking quashing of the said FIR in Crime No.127 of 2023 and this hon'ble Court was pleased to pass an - 5 - HC-KAR NC: 2026:KHC:16070 WP No. 22003 of 2023 interim order of stay of further investigation in respect of all the petitioners except the first of us. Vide order dated:6-11-2023. 5. We state that second of us had filed a Crl. Misc. No.783/24 before 1st Addl. Principal judge, Family court, Mysuru under provisions of Domestic Violence Act. In the court of pendency of all the proceedings, due to intervention of court, Advocates, Family and friends, both the parties have sat together and discussed and decided to resolve the disputes amicably and in furtherance of the said discussion parties have decided to withdraw all the cases and accusation's and allegations against each other including the present FIR and they had filed a petition under section 13B of Hindu Marriage Act before Ist Addl. Prl. Judge, Family Court at Mysuru in MC No.16/2026 and detailing the terms of settlement. 6. As agreed, the first of us has paid a sum of Rs.10,00,000/-(Rupees ten lakh only) to the second of us before the Family court and the Hon'ble Family Court was pleased to record the evidence of the parties and passed the judgment of dissolution of our marriage dated: 20-4-2018, on 5-3-2026. 7. In furtherance to the said settlement both of us are here before this Hon'ble court filing the present application. The first of us is paying balance amount of RS.11,00,000/- (Rupees eleven lakhs only) the second of us through DD No.000434 dated: 21-2-2026, drawn on - 6 - HC-KAR NC: 2026:KHC:16070 WP No. 22003 of 2023 Bank of India, Delhi gate branch, Palanpur, which the second of us acknowledges and states that, she has no balance receivable from the first of us. 8. Further the parties have exchanged their belonging before the family court at Mysuru and the remaining items were exchanged today by the parties and they have no claim whatsoever against each other. 9. The second of us has no objection for this Hon'ble court quashing the proceedings in Crime No.127/2023 against all accused persons by accepting present compromise. Wherefore both the deponents that is petitioner No.1 and Respondent No.2 most humbly pray that this Hon'ble court may be pleased to allow the accompanying application and quash the FIR in Crime No.127/2023 pending on the file of 7th Addl. Civil Judge, and JMFC JLB Road, Mysuru., for the offence punishable under section 498A, 354A, 504, 506, 149 IPC R/W Section 3 and 4 of D.P. Act against all the accused to meet the ends of justice.” 3. The petitioner No.1 and the respondent No.2 are present in person and they are identified by their respective counsel. Both of them agree that they have settled the dispute amicably as set out in the joint affidavit. The petitioner No.1 has handed over a demand draft for a sum of Rs.11,00,000/- as mentioned in the joint affidavit, the receipt of which is acknowledged by the respondent No.2. 5. In view of the above, the petition is allowed. The criminal proceedings launched by the respondent No.1 against the petitioners in Crime No.127/2023 for the offences punishable under Sections 498A, 354A, 504, 506 read with Section 149 of the Indian Penal Code, 1860 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, is quashed.
