Also heard Mr. Bidyut Sarma, the learned Additional Public Prosecutor appearing for the State of Assam as well as Ms.T Parasar, the learned Amicus Curiae appearing for the respondent No.2. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner has Page No.# 2/2 prayed for releasing him on bail, after he was arrested in connection with Mayong P.S. Case No.32/2025 arising out of POCSO Case No.77/2025. 3. The petitioner has objected to this bail application by stating that only three witnesses remained to be examined. 4. Mr. Poddar has pointed out to the statements of the witnesses, more particularly, the victim. 5. Mr. Poddar submits that the petitioner has already spent more than 400 days in judicial custody. 6. I have considered the submissions made by the learned counsels of both sides in the light of the ailments of the victim. 7. This Court is of the opinion that at this stage, the prayer of the petitioner should be accepted considering the period of detention of the petitioner in custody. 8. Therefore, his bail application is allowed. 9. It is hereby directed that the petitioner, Md. Firuj Ali, who was arrested in connection with Mayong P.S. Case No.32/2025 arising out of POCSO Case No.77/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Special Judge (PoCSO), Morigaon.
