ORDER This writ petition has been filed to direct the second and sixth respondent to reimburse the balance amount of medical expenses to the tune of Rs.2,06,889/- incurred by the petitioner as per the recommendations made by the fifth respondent vide Lr.No.4063/Ma.Ku.2025 dated 23.10.2025. 2/8 https://www.mhc.tn.gov.in/judis W.P.No.9051 of 2026 2.The case of the petitioner in brief is that the petitioner is a retired Government servant who was receiving pension and as per the G.O.Ms.No.204, Finance (Health Insurance) Scheme dated 30.06.2022, pensioners (including spouse) / family pensioners shall avail the medical assistance upto the limit of Rs.5 lakhs in a block period of four years from 01.07.2022 to 30.06.2026 as a cashless model for the approved treatments / surgeries and the petitioner has taken the medical treatment in the Meenakshi Hospital from 14.01.2024 to 19.04.2024 and the medical expenses of Rs.3,46,889/- has been referred to the sixth respondent / insurance company for reimbursement. However, a sum of Rs.1,40,000/- was approved by the sixth respondent, though the limit has been fixed upto Rs.5 lakhs. Hence, the petitioner has given a detailed representations to the second and fourth respondent to direct the sixth respondent to reimburse the balance amount of Rs.2,06,889/- and the fourth respondent has forwarded the same to the sixth respondent and the sixth respondent, in turn, has returned the documents stating that as per Letter No.29735/Finance (HI-2) 2023-2 dated 14.07.2024, reimbursements are applicable only for the admissions between 01.07.2023 to 30.06.2024 and the claim of the petitioner was received only on 20.09.2024. 3/8 https://www.mhc.tn.gov.in/judis W.P.No.9051 of 2026 3.It is stated that if there is any cut off date fixed by the Government, the claims of the persons made before the cut off date has to be placed before the District Level Empowered Committee, however, the petitioner’s claim was not placed before the said committee. Thereafter, the petitioner made representations to the 2nd , 3rd and 4th respondents and subsequently, vide letter dated 23.10.2025, the fifth respondent has forwarded 22 claims of the pensioners including the petitioner to the second respondent to reimburse the medical expenses. However, till date, no amount has been paid to the petitioner and hence, the petitioner has come to this court by way of this writ petition. 4.Heard the learned counsel for the petitioner and the learned Government Advocates appearing for the respondents and perused the materials available on record. 5.The learned counsel for the petitioner has relied on the Judgment of the Hon’ble Supreme Court of India in the similar case in Shiva Kant Jha vs. Union of India reported in (2018) 5 MLJ 317, where the Insurance company was directed to pay the balance amount of medical expenses to the petitioner and it is submitted that though the documents of the petitioner have been forwarded to the second 4/8 https://www.mhc.tn.gov.in/judis W.P.No.9051 of 2026 respondent to pass orders on the request for medical reimbursement of the pensioners as early as in 2025, the second respondent is yet to take decision on the same. 6.In view of the aforesaid facts and circumstances of the case, the second respondent and the sixth respondent are directed to pass orders based on the letter forwarded by the fifth respondent dated 23.10.2025 within a period of three weeks from the date of receipt of a copy of this order. 7.Accordingly, this writ petition is disposed of with the above direction. No costs.
