Petitioner sought his impleadment in a suit filed by Respondent No. 1. His application filed under Order 1 Rule 10 C.P.C. was rejected. Thus aggrieved, petitioner has approached this Court seeking the following reliefs: “i. To issue a writ, order or direction in the nature of the nature of certiorari quashing the impugned order dated 31.1.2020 passed by the Learned Civil Judge, Junior Division, Vikasnagar District Dehradun in O.S. No. 19 of 2010, Pooja Verma Vs. Devendra Kumar Bansal whereby an application Under Order 1 Rule 10 of CPC has been dismissed contained as (Annexure no. 5). ii. To issue a writ, order or direction in the nature of the nature of certiorari quashing the impugned order dated 20.1.2021 passed by Learned Additional District Judge, Vikasnagar, Dehradun in Civil Revision No. 2 of 2020 Sunil Kumar Vs. Smt. Pooja & Another contained as (Annexure no. 6).” 4. Mr. Amar Murti Shukla, learned counsel for the respondent No. 1, on instruction, submits that he has no objection if the writ petition is allowed and petitioner is directed to be impleaded as UKHC010017722021 2026:UHC:6096 defendant in the suit. 5. In view of the concession made by learned counsel for Respondent No. 1, the writ petition is allowed; impugned order dated 31.01.2020, passed by learned Trial Court is set aside and Sunil S/o Prem Chand is directed to be impleaded as defendant No. 2 in OS No. 19 of 2010. Learned Trial Court is requested to make endeavour to decide the suit within eighteen months.
