For Petitioner: Mr.G.Balamanikandan For Respondents: Mr.P.Balathandayutham Special Government Pleader for R1 to R4 ORDER The above writ petition has been filed seeking a mandamus to the respondents to refund a sum of Rs.3,16,598/- which was deducted from the petitioner's monthly salary towards subscription of Contributory Pension Scheme along with interest for the delay in refunding the said amount. 2. The petitioner is an Ex-Army Personnel. He was appointed as Sub- Inspector of Police in Bomb Detector and Disposal Squads in Trichy City on 06.05.2017 and joined the duty. His appointment is temporary and it is on contract basis for a period of minimum one year, with minimum scale of pay. The petitioner would submit that he is not eligible to receive any benefits viz., increments, pensionary benefits including gratuity as like permanent employees. His services was extended periodically from time to time. The authorities inadvertently had assigned CPS A/c.No.7000332264 and had deducted a portion of his salary towards CPS contribution. This runs to a sum of Rs.3,16,598/- for the period 2017 to 2023. Therefore, the petitioner had submitted several representations including the one dated 23.01.2026, requesting to refund the above said amount. However, the same was not considered to date. Hence, the petitioner is before this Court. 3. Admittedly, the mistake committed by the respondents have to be rectified in all fairness. Hence, a mandamus is issued to the 3rdrespondent to consider the representation of the petitioner dated 23.01.2026 and to pass necessary orders directing to refund the said sum which has been deducted from the petitioner's monthly salary towards CPS contribution along with permissible interest if any for the delay, within a period of six weeks from the date of receipt of a copy of this order. 4. With the above directions, the writ petition is disposed of.
