The instant petition is preferred under Section 528 of BNSS 2023 on behalf of the applicant, namely, Azeem Beg, S/o Zafar Beg wherein he is praying for quashing of Special Sessions Trial No. 35 of 2023, State vs. Azeem Beg, wherein the present applicant is facing the trial for the offences punishable under Sections 363, 366A and 376 IPC read with Section 3/4 of the POCSO Act. 5. The petition is filed along with the compounding application,i.e., IA No. 1 of 2026 supported with the affidavit of the applicant and respondent no. 2-complainant/father of the victim who as on date is now major. 6. Compounding application has been moved to close this proceeding on the ground that due to intervention and consent of the family members of the applicant as well parents of the victim both the applicant and respondent no. 3 married on 02.09.2024 and their marriage is also registered on 09.09.2026 before the Registrar, Compulsory Registration of Marriages, Dehradun, the copy of which is UKHC010124952026 2026:UHC:6050 enclosed at page 87. 7. It is contended by the learned counsel for the parties that since parties have resolved their disputes and both the applicant and the victim who were in fact in love now married with each other, therefore, continuation of the proceeding is completely a futile exercise and if the proceeding is permitted to continue it will disrupt their matrimonial life. 8. The applicant as well as his mother and the respondent/complainant and his daughter (victim) are present in Court and identified by their counsel. 9. Ms. Meenakshi Sharma , learned A.GA. also submits that since now applicant married with the victim and their marriage is also registered, therefore, continuation of the proceeding is completely a futile exercise. 10. After hearing the submissions of the learned counsel for the parties and taking into consideration that since the applicant is now married with the victim with the consent of parents of both the parties, therefore, continuation of the trial court proceedings is completely a futile exercise and even otherwise if such a proceeding is permitted to continue it will affect their matrimonial life. 11. Accordingly, the instant C528 application as well as compounding application are allowed. The proceeding of S.S.T. No. 35 of 2023, State vs. Azeem Beg, pending in the court of Fast Track Court/ Special Judge (POCSO)/Addl. District and Sessions Judge, Dehradun is also hereby quashed. 12.
