Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- 2 10.1 That, this Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondent authorities to expeditiously consider and decide the petitioner’s application dated 21.02.2023 for ex-gratia compensation of Rs.4,00,000/- under Clause 6-4 of the Revenue Book Circular, within a time-bound period of 30 days from the date of order, taking into account all submitted documents and without insisting on extraneous requirements like the FSL report. 10.2 That, this Hon’ble Court may kindly be pleased to direct the respondents to grant the aforesaid compensation amount to the petitioner along with interest at the rate of 9% per annum from the date of application i.e. 21.02.2023, till the date of actual payment, to compensate for the undue delay. 10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate. 2. Learned counsel appearing for the petitioner submits that petitioner’s son namely, Ashish @ Mahendra Nishad died on 03.07.2022 due to snake bite at Vijay Nagar, near Durga Manch, Pardi, Nagpur, District Nagpur, Maharashtra, therefore, petitioner filed an application for grant of compensation / financial assistance amounting to Rs.4,00,000/- as provided in Clause 6-4 of the Revenue Book Circular before respondent No. 4 – Naib Tahsildar, Khairagarh, who submitted its report to the Sub Divisional Officer (Revenue), Khairagarh, but he remitted the matter back to Naib Tahsildar, Khairgarh on the ground that there is no specific finding in post mortem report about the cause of death of petitioner’s son, as Histopathological report has not been received. He further submits that this petition may be disposed of directing respondent No 3- Sub Divisional Officer (Revenue), Khairgarh to decide 3 the revenue case No. 202302290700043/ c-125/2023-24 immediately after obtaining Histopathological report /viscera report of son of petitioner. 3. Learned counsel for the State has no objection to allow the limited prayer made by counsel for the petitioner. 4. Having considered the contention putforth by learned counsel for the parties and the documents annexed with the petition, since exact cause of death of son of deceased has not been reported by the doctor because of absence of Histopathological report / viscera report, therefore, Sub-Divisional Officer, Khairagarh is directed to decide the revenue case No. 202302290700043/ c- 125/2023-24 immediately after obtaining Histopathological report /viscera report of son of petitioner. 5. With the aforesaid observations & directions, the writ petition stands disposed of. No costs. 6. Pending interlocutory application (s), if any, stands disposed of.
