1. 2 direction, quashing/set-aside the order dated 08.10.2025 in appeal no. 32/2025 by the State Transport Appellate Tribunal Raipur so far as it relates to remitting back the matter to the RTA for fresh hearing by the respondent no.02.
10.3. That, the Hon'ble Court may further be pleased to stay the further proceedings of the RTA relates to rehearing of the matter as directed by the STAT as per order impugned, till the nest date of hearing. 10.4 Any other relief which this Hon'ble Court may deems fit and proper looking to the facts and circumstances of the case may also be awarded to the petitioner including the cost and expenses of this petition.

Learned counsel for the petitioner would submit that, vide order dated 8-10-2025 (Annexure P-1) passed in Appeal No. 32/2025, the State Transport Appellate Tribunal, CG, Raipur ( henceforth referred to as ‘STAT’) has remitted back the matter to the respondent No. 2/Regional Transport Authority, Raipur to pass order afresh within 60 days, despite that, the respondent No. 2 has not decided the matter. He further submits that, an application has also been filed by him on 20-11-2025 (Annexure P-6) before the respondent No. 2, but the same has not been decided. Hence, learned counsel for the petitioner submit that, this petition may be disposed of directing the respondent No. 2 to comply with the order dated 8-10-2025 passed by the STAT in appeal No. 32/2025 and decide the application Annexure P-6 within stipulated period.

Learned counsel for the State submits that the matter is under
consideration and order will be passed expeditiously.

In instant case, the STAT, Raipur has directed the respondent No. 2 to decide the case within 60 days, but thereafter more than 5 months have passed but the respondent No. 2 has not passed order in the matter. Therefore, having considered the submission made by learned counsel for the parties, this writ petition is disposed of directing the respondent No. 2 to decide the case in accordance with law within 30 days from the date of receipt of copy of this order.
5. With the above observations and directions, this writ petition stands
disposed of.
