[2] The present petition has been filed under Article-226 of the Constitution of India directing the respondents for issuing transit permit for 30 numbers of trees situated at Mouja Birchandranagar, under Pecharthal P.S., Unakoti district, Tripura, Khatian No.37, CS Plot No.05. [3] The petitioners have prayed for the following reliefs: a. To admit the writ petition b. Issue notice to the respondents. c. Call for the records from the custody of respondent Nos.1, 2, 3 & 4. AND d. After hearing both the parties be pleased to direct the respondents to issue transit permit in favour of the petitioner. e. To grant compensation of Rs.15,00,000/- (Rupees fifteen lakh) only by the respondents for financial loss and Rs.1,00,000/- (Rupees one lakh) only for mental harassment.” [4] The facts in brief are that the petitioners belong from tribal community and lawful allottees of land since 1984 under the Tripura Land Revenue and Land Reforms (Allotment of Land) Rules, 1980. They have been in peaceful possession of the land and depend on forest plantation for their livelihood. After due verification by the Revenue and Forest departments, the petitioners were granted permission to extract 30 numbers of trees, which were lawfully extracted. However, extraction of 30 numbers of trees the respondent No.4 have refused to issue transit permit on the basis of verbal complaint made by some unknown person and they kept the permission in abeyance arbitrarily till date. Despite repeated applications and legal notice, no transit permit has been issued. Due to this illegal inaction, the extracted timber has been damaged, causing heavy financial loss and affecting the petitioners’ livelihood. [5] The petitioners found the respondents inactive in performing their statutory duties and under compulsion to redress their grievances, approaches before this Court for an appropriate direction by filing the present writ petition. [6] It is seen from the record i.e. the order passed by the SDFO dated 10.01.2024 that a verbal complaint received against the jote land of the Sri Purna Kumar Chakma and hence, he was directed to produce necessary documents for further action. In view of above and having heard the learned counsel appearing for the parties, without expressing any opinion on merits, this Court is of the view that ends of justice would be met if the matter is disposed of by directing the respondents to consider the case of the petitioners in terms of order dated January, 2024 in accordance with law and after the decision is taken by the concerned respondents, the same may be communicated to the petitioners.
