IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.1448 of 2026 Chandan Pradhan …. Petitioner Mr. S. Behera, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. N. Das, ASC And ABLAPL No.2130 of 2026 Kunu @ Subham Subudhi …. Petitioner Mr. A. Pattanaik, Advocate -Versus- State of Odisha …. Opposite Party Mr. S. N. Das, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 16.03.2026 01. 1. Both the ABLAPLs are taken up together for orders. 2. Heard learned counsels for the respective parties. 3. Instant petitions under Section 482 BNSS are filed for pre-arrest bail of the petitioners in connection with Tangi P.S. Case No.55 of 2026 corresponding to G.R. Case No.59 of 2026 pending in the file of learned Grama Nyayalaya/J.M.F.C., Tangi on the grounds stated therein. 4. Perused the F.I.R. dated 19th January, 2026 as at Annexure-1. The counter F.I.R. has been lodged from the side of the petitioners at Annexure-2 in ABLAPL No.2130 of 2026. The further submission is that there was a quarrel between both the sides and it has led to the alleged incident and lodging of the F.I.Rs. against each other. From the counter F.I.R. at Annexure-2, the Court finds that the alleged occurrence has taken place after a fight broke out between the parties. It is further revealed that nearly 200 people were involved in the alleged incident. The names of the petitioners are mentioned in the F.I.R. i.e. Annexure-1. Recorded the objection of learned counsel for the State. It is informed to the Court that the parties do not have any similar antecedent. Considering the submissions as above and absence of antecedents of any, the petitioners were involved in the incident, for which, counter F.I.R. has been lodged by them, this Court is of the view that though a case of pre-arrest bail is not made out, but all of them should be directed to surrender before the learned court below for being released with suitable conditions imposed. 5. Accordingly, it is ordered. 6. In the result, ABLAPLs stand disposed of with the direction as aforesaid. Consequently, it is directed that upon surrender before the court of learned Grama Nyayalaya/J.M.F.C., Tangi within a fortnight from today, the petitioners shall be released on bail in connection with Tangi P.S. Case No.55 of 2026 corresponding to G.R. Case No.59 of 2026 subject to them furnishing bail bonds of Rs.20,000/- (Rupees twenty thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, they shall not pick up any quarrel or fight with the other side, while on bail and to co-operate the I.O. in the investigation of the case, till it is over. It is further directed that the above order not be given effect to if any of the petitioners is having similar antecedent. 7. Issue urgent certified copy as per rules. (R.K. Pattanaik) Judge Sumitra
