1. Ms. Mansi Chauhan and Ms. Shakshi Furtyal, learned counsel for the applicant.
2. Mr. Pratiroop Pandey, learned A.G.A. for the State.
3. The present applicant ‘Rajpal Singh’ S/o Sri Gurmeet Singh is praying for bail in reference to First Information Report dated 20.03.2026 bearing FIR No. 0057 of 2026 P.S. Nanakmatta, District Udham Singh Nagar, wherein, the present applicant is implicated by one Simran Kaur for the offences punishable under sections 115, 351(2), 352, 82 and 85 r/w section ¾ of D.P. Act.

It is argued that the present applicant is innocent and has been falsely implicated and the allegations that the applicant had entered into a registered marriage with one Charu Awasthi is completely false and frivolous and she is not his legally wedded wife. She further argued that the allegation with regard to the second marriage is not admitted by the applicant and the document as appended along with the counter affidavit particularly page-34 is not admitted since the applicant never married with the lady namely Ms. Charu.. She further submits that the present applicant is innocent and is languishing in jail since 12.05.2026 and if he is enlarged on bail he will cooperate with the ongoing investigation.

Learned counsel for the applicant also placed reliance to certain Whatsapp Chats in between Charu Awasthi with the victim.
6. On the other side, Mr. Pratiroop Pandey,

2026:UHC:6017 learned A.G.A. submits that the investigation is going on and the document enclosed at page-34 primarily establishes that the applicant married with Charu and this fact has not been disclosed to the victim at the time when the present applicant married with the victim. He submits that there are sufficient evidences against the applicant but the charge-sheet has not been filed.
7. After hearing the submission of learned counsel for the parties and perusing the record and in view of the discussions as above, this court is of the view that the applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
9. Let the applicant ‘Rajpal Singh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of court concerned subject to the following conditions: i. The applicant shall cooperate with the ongoing investigation and will not make any attempt to influence any of the witnesses or to give any threatening and will focus on the restoration of his matrimonial life with the victim. ii. The applicant shall not leave the country without leave of the Trial Court and shall immediately surrender his passport, if any, to the Trial Court positively within three days from the date of release on bail.
