1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“(a) Issue a writ of mandamus directing Respondent Nos. 5 and 6 (NIELIT and NIELIT Ajmer Campus) to forthwith issue the No Objection Certificate (NOC), Transfer Certificate (TC), and all consequential academic records required for the Petitioner's transfer/migration on medical grounds (including marksheets, grade cards, and migration/transfer-related This is a digitally signed order. certificates), within 48 hours of the order of this Hon'ble Court; the medical evidence placed on record being uncontroverted and the academic record being unimpeached, the factual basis for grant of this relief stands fully established; (b) In the alternative to Prayer (i) above, issue a writ of certiorari and/or mandamus quashing the impugned AICTE communication dated 05.02.2026 (F. No. 1- 102/AICTE/PGRC-GC/2026) routing the Petitioner's grievance to the SGRC of Gurugram University, and directing Respondent Nos. 5 and 6 to place the Petitioner's request for NOC/TC before the competent authority within NIELIT and to decide the same by a reasoned speaking order after affording an opportunity of hearing, within 7 days (or such shorter period as this Hon'ble Court deems fit); (c) Direct that upon issuance of NOC/TC whether pursuant to Prayer (i) or Prayer (ii) above, Respondent Nos. 5 and 6 shall simultaneously issue all academic documents including marksheets, migration certificate, and any other institutional records required for admission to the receiving institution, so as to ensure academic continuity without further procedural delay; (d) Issue a writ of mandamus directing Respondent Nos.
3 and 4 (AICTE and UGC) to ensure, consistent with their respective statutory mandates and the UGC Multiple Entry/Exit framework, that no student in the Petitioner's position is left This is a digitally signed order. without an effective, competent, and time-bound remedy by reason of inter-authority deflection; (e) Pending disposal of the present writ petition, direct Respondent Nos. 5 and 6 to: (i) maintain status quo with respect to the Petitioner's enrolment and academic standing; (ii) permit the Petitioner to appear in the Semester IV examinations scheduled in May 2026 and to complete all internal assessments, practicals, and other academic requirements pending before those examinations, without any adverse consequence by reason of the pendency of this petition or of the Petitioner's transfer request; and (iii) take no adverse or coercive action affecting the Petitioner's academic status, attendance record, or examination rights on account of the present proceedings; (f) Award costs of the present petition in favour of the Petitioner and against the Respondents; . . .”
2. Ms. Zaidi, learned counsel for the petitioner, states that she is satisfied if the prayer ‘a’ is granted. 3. Mr. Rai, learned counsel for the respondent Nos. 5 and 6, states that since the petitioner is seeking transfer, respondent Nos. 5 and 6 will issue the No Objection Certificate, in accordance with the extant rules and regulations, to the institute where the petitioner is desirous of taking admission. 4. Taking his statement on record and binding the respondent Nos. 5 and 6 to the same, the present petition is disposed of. 5. Consequently, pending applications, if any, are also disposed of.
