Respondent(s) For Petitioner(s) : Mr. Shahid Ahmed Ansari, Advocate For State / Respondent No. 7 : Mr. Vivek Siddharth Ojha, PL Hon’ble Shri Justice Sachin Singh Rajput 2 Order on Board 18/02/2026 Learned counsel for the petitioner submits that the petitioner being the plaintiff has filed a civil suit for declaration of title and permanent injunction before the Civil Judge Junior Division, Surajpur, District Surajpur CG on 16.06.2025 which is registered as Civil Suit No. 122A/2025. Along with the plaint, the petitioner has also filed an application for temporary injunction under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure. The respondents/defendants have been duly served and have entered appearance before the learned Civil Judge. However, till date the application filed under Order XXXIX Rules 1 and 2 CPC has not been decided. Therefore, learned counsel prays that the learned Civil Judge may be directed to decide the said application within a stipulated period of time in accordance with law. 2. Heard learned counsel for the petitioner and perused the record. 3. From a perusal of the order-sheets appended with the writ petition, it appears that the suit was filed in the month of June, 2025 and since then the matter has been adjourned on different occasions. Till date, the application filed under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure has not been decided. Thus, it is expected that the learned Civil Judge shall decide the said application preferably within a period of two months from the next date of hearing of the suit before it in accordance with law. 4.
