2. Mr. Himanshu Sain, learned AGA, for the State of Uttarakhand.

The present applicant – Manoj Kumar S/o Shri Rajendra Kumar, is praying for bail in a reference to FIR dated 16.03.2026 bearing FIR No.91 of 2026, Police Station Transit Camp, District Udham Singh Nagar, wherein, on completion of the investigation in total three persons have been chargesheeted including the present applicant for the offences punishable under Sections 109 of BNS, 2023 read with Sections 3, 5, 25, 26 and 27 of the Arms Act.

It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and in fact in the said incident the co-accused sustained gunshot injury, but he is also made an accused though as per prosecution it is a case of no injury. He further submits that the applicant has no criminal antecedents and the chargesheet has been filed and is languishing in jail since 16.03.2026.
5. On the other side, Mr. Himanshu Sain, learned AGA, have not disputed that the chargesheet has already been filed and the present applicant have no criminal antecedents.
6. After hearing the submissions of the learned counsel for the parties, and taking into consideration that the present applicant is languishing in jail since 16.03.2026, and the chargesheet has already been filed
and the applicant has no criminal antecedents, this Court is of the view that the applicant deserves for bail.
7. Accordingly without expressing any opinion on the merits of the case, bail application is allowed.
8. Let the applicant – Manoj Kumar, be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount to the satisfaction of the Court concerned.
