ORDER:
The present writ petition is filed under Article 226 of the Constitution of India seeking following relief:
“to issue an order, writ or direction more particularly in the nature of Writ of Mandamus declaring the inaction of the respondent Nos.3 and 4 in considering petitioner’s online application vide application No.NC012609877965, dated 01.07.2026 for new power connection to the petitioner’s house situated at Plot No. 146, H.S.No.267/91 in Sy.No.952, NGO Colony, Madakalavaripalli,
Gopavaram Mandal, Badwel Municipality, as illegal, arbitrary and consequently direct the respondents, particularly respondent Nos.3 and 4 to issue power connection to the petitioner’s house situated at Plot No.146, H.S.No.267/91 in Sy.No.952, NGO Colony, Madakalavaripalli, Gopavaram Mandal, Badwel Municipality by considering the application of
the petitioner vide application No.NC012609877965, dated 01.07.2026 and pass such order or orders….”
2. Heard learned counsel for the petitioner and learned Standing Counsel for the respondents. 3. The case of the petitioner herein is that the petitioner is claiming as owner and possessor of the property admeasuring to an extent of Ac.0.08 cents in Plot No.146, H.S.No.267/91 in Sy.No.952, NGO Colony, Madakalavaripalli, Gopavaram Mandal, Badwel Municipality, YSR Kadapa District, having acquired the same from her vendor on 18.11.2024. After such

acquisition, due to the interference by the third parties, petitioner herein filed O.S.No.5 of 2025 seeking a relief of permanent injunction, wherein the defendants were became ex-parte, accordingly, permanent injunction was granted in favour of the petitioner in respect of the present subject property. She further claims that the subject land was an assignment land which was made in favour of the vendor’s vendor of the petitioner not on the ground of landless poor person but for market value. It is further submitted that the subject assignment was made for market value after receipt of market price and the vendor’s vendor of the petitioner who is an assignee was conveyed the valid title with freehold rights. Therefore, the petitioner is entitled for absolute rights in her favour and the respondents cannot be permitted to deny the electricity service connection pursuant to the application submitted by the petitioner. Hence, the Writ Petition. 4. On the other hand, learned Standing Counsel for the respondents submits that on perusal of the copy of the patta granted in favour of the vendor’s vendor in the year 1982, it is a D-Form patta only and there is no whisper about alleged freehold rights as contended.
It is simply an assignment patta in favour of the landless poor persons. Due to which only, no sale deed was said to have been executed either in favour of the vendor of the petitioner or in favour of the petitioner even though the petitioner is claiming that she got acquired the subject property from her vendor, who in turn acquired from an assignee. He further submits that present application itself is not in order and not annexed with an indemnity bond as required to sanction fresh electricity

service connection. Moreover the petitioner filed Writ Petition i.e., W.P.No.28981 of 2024 against the revenue authorities challenging their interference, wherein, this Court specifically directed all the parties concerned to maintain status-quo till next date of hearing. The same is pending for
consideration before this Court. In view of the said interim orders, it is not appropriate to this Court to direct the respondents to grant new electricity service connection in respect of the property of the petitioner contrary to the earlier orders of this Court. 5. Heard both the learned counsel and perused the material placed on record. It is observed that the nature of the subject land appears that is an alienated land by way of an assignment for land less poor. Even though there is a recital of receipt of amount but it was not clarified in other conditions of the patta stating that the subject land was allotted for market value and all the recitals of the patta is as good as conditions of D-Form patta and even the heading of the patta itself indicates as a DKT pata granted for land less poor in the year 1982. Therefore, the claim of the petitioner that the subject alienation was granted for market value and therefore the vendors of the petitioner were conferred freehold rights for alienation of the subject property is contrary to the conditions of the subject assignment patta pertains to the year 1982. As contended by the learned Standing Counsel that in view of the status-quo granted by this Court in W.P.No.28981 of 2024 in respect of the subject property, now this Court could not be invited for another direction in deviation to earlier orders of this Court, which is pending for granting any

electricity service connection is a merit submission. Even though the petitioners therein are not parties to the present Writ Petition but in view of the status-quo in respect of the subject property, every authority should maintain status-quo in respect of the subject property. Since the petitioner submitted an application narrating the facts and entitlement of the petitioner, this Court is inclined to dispose of the writ petition, directing the respondents to consider the application dated 01.07.2026 submitted by the petitioner and pass a speaking order with reference to the earlier orders pending against the subject property, within a period of four(4) weeks from the date of receipt of copy of this Order. 6. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
