JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.10879/2026, pending before the VIII Additional Chief Judicial Magistrate, Bengaluru, for the offences under Sections 127(2),351(2), 64 and 75(2) of the BNS, 2023. 2. Learned counsel for the petitioner – accused No.1 and respondent No.2 – complainant in unison submit that during the pendency of these proceedings, the parties to the lis have settled their disputes amicably by drawing up certain terms and conditions. The parties have filed a joint affidavit before this Court seeking permission to compound the offences. 3. The joint affidavit reads as follows: - 3 - HC-KAR NC: 2026:KHC:17679 CRL.P No. 3615 of 2026 “I, MANJUNATH REDDY T.N., S/o Nagaraja Reddy T.K., aged 27 years, R/at No.32/A, Bommasandra Post, Thirupallya, Bommasandra Industrial Estate, Anekal, Bengaluru-560099, the Petitioner/Accused, do hereby solemnly affirm and state as follows: AND I, ALAKSHYA GOSWAMI, D/o Kangkan Goswami, aged 21 years, R/at Villa 104, La Ville Township, Sy.No.30/31/32, Adigarakallahalli, Byalahalli, Sarjapur, Anekal Hobli, Bengaluru City - 562107, Respondent No.2/De-facto Complainant No.1, do hereby solemnly affirm and state as follows: 1. BACKGROUND OF SETTLEMENT 1.1 The parties have amicably decided to settle all disputes arising from Crime No. 223/2025 of Hebbal Police Station, Bengaluru City, registered for offences under Sections 127(2), 351(2), 64 and 75(2) of the Bharatiya Nyaya Sanhita, 2023. 1.2. The de-facto complainant (Respondent No. 2), after due deliberation with her family and legal counsel, have voluntarily agreed to the settlement without any coercion, inducement, pressure or consideration. 1.3 The parties seek setting aside of the FIR and entire proceedings under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 to prevent abuse of process and secure ends of justice. 2. TERMS OF SETTLEMENT ABSOLUTE SAFETY & NO-CONTACT UNDERTAKING 2.1 The Parties undertakes and binds themselves that he/she, their family members, relatives, agents, employees, associates or any person acting on their behalf SHALL NEVER, DIRECTLY OR INDIRECTLY: i. Contact, communicate, meet, approach or visit Accused/ Respondent No 2, their family members, friends, hostel-mates, college staff, classmates or any person - 4 - HC-KAR NC: 2026:KHC:17679 CRL.P No. 3615 of 2026 connected with them through any medium whatsoever including but not limited to: a. Phone calls, WhatsApp, SMS, social media (Instagram, Facebook, Snapchat etc.) b. Email, letters, parcels or any form of communication c. Physical presence or surveillance ii. Commit, abet, encourage or threaten any form of: a. Intimidation, harassment (physical, verbal, sexual, cyber etc) b. Defamation (social media, community gossip, media interviews etc) c. Stalking, surveillance or any act causing mental, physical or social harm/distress etc. iii. Cause harm to other family members a. Target the family members and cause trouble to them and their friends b. Stalk on social media and intrude their digital privacy c. Hover around in the residential areas of the residence of the Complainants iv. Neither party, their family members, relatives, agents or associates shall hover around, visit, enter the residential premises or vicinity of the other party's residence, namely: a. No.32/A, Bommasandra Post, Thirupallya, Bommasandra Industrial Estate, Anekal, Bengaluru- 560099 (Accused's residence) b. Rajiv Gandhi College of Dental Sciences, Cholanagar, Bengaluru-560032. d. Girls' Hostel, Rajiv Gandhi College of Dental Sciences, Cholanagar, Bengaluru-560032 (Respondent No. 2's hostel) 2.2 BREACH OF SAFETY UNDERTAKING shall constitute contempt/Initiate proceedings for cancellation of bail before this Hon'ble Court and be punishable accordingly. Proceedings in Crime No. 223/2025 shall stand automatically revived upon proof of violation. 2.3 NO FUTURE LITIGATION & MUTUAL RELEASE The parties mutually and irrevocably undertake: a. Accused (Petitioner) shall never initiate, file or pursue: - Defamation proceedings - Malicious prosecution claims - Civil suits for damages - Any criminal complaint against Respondents No.2 or their families relating to this incident b. Respondent No.2 shall not pursue any further complaints, proceedings or claims against Accused relating to events of 22.12.2025 post-settlement. 2.4 CONFIDENTIALITY & NON-DISCLOSURE Parties shall maintain absolute confidentiality regarding: a. Settlement terms and discussions. b. Incident details and communications etc. c. No public statements, media interviews or social media posts etc. 2.6 VOLUNTARY WITHDRAWAL & NO OBJECTION Respondent No.2 state they have voluntarily withdrawn all animosity against the Accused. They have no objection whatsoever if: - 6 - HC-KAR NC: 2026:KHC:17679 CRL.P No. 3615 of 2026 a. FIR in Crime No. 223/2025 is quashed b. All consequential proceedings are terminated c. Accused's bail is vacated post-quashing 3. They confirm no pressure, coercion, inducement or consideration was offered by Accused, his family or any third party. 4. Continuation of criminal proceedings will cause irreparable mental trauma to Respondents No. 2 and serve no useful public purpose. 5. Both de facto complainants are pursuing medical education. Prolonged litigation affects their academic performance, mental health and future prospects PRAYER Parties most humbly pray this Hon'ble Court may be pleased to: a. Set aside/quash the proceedings in SC 406/2026 arising out of Crime No. 223/2025 of Hebbal Police Station pending before the LIII Addl. City Civil and Sessions Judge; b. Record undertakings given herein as binding and enforceable by contempt jurisdiction; c. Pass such other orders as deemed fit in interest of justice. Verified at Bengaluru on this 27th day of March, 2026 Since the offence alleged against the petitioner is under Section 64 of the BNS, a perusal at the narration made in the complaint itself would not indicate any ingredients of Section 64 - 7 - HC-KAR NC: 2026:KHC:17679 CRL.P No. 3615 of 2026 of the BNS. In that light, I deem it appropriate to accept the joint affidavit of the parties and obliterate the proceedings against the petitioner – accused No.1. 4. For the aforesaid reasons, the following: ORDER a. The criminal petition is disposed. b. The proceedings in C.C.No.10879/2026, pending before the VIII Additional Chief Judicial Magistrate, Bengaluru, qua the petitioner, stands quashed. Pending I.As’. stand disposed, as a consequence.
