Kausik (Allowed) CRM (NDPS) 638 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sagarpara Police Station Case No. 813 of 2025 dated 08.09.2025 under section 20(b)(ii)(C)/29 of the NDPS Act, 1985. And In the matter of : Babu Sk ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh Ms. Ankusha Ghosh ……for the Petitioner. Mr. Bitashok Banerjee Mr. Karan Bapuli ……for the State. Learned advocate appearing for the petitioner submits that the subject matter of the case relates to alleged recovery of 21.550 Kgs. of Ganja. However, the petitioner has been implicated on the basis of statement of co-accused and there has been no recovery from the present petitioner. Learned advocate for the State, on the other hand, opposes the prayer for bail. This Court specifically asked the learned advocate for the State, as to whether there were any antecedents or call data records so far as the present petitioner is concerned. Learned 2 advocate for the State replied that there are no materials in the case diary suggesting the same. Having considered the fact that charge sheet has already been submitted and the petitioner has been arrested on the basis of statement of co-accused, I am of the view, further detention of the petitioner is unwarranted. Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Babu Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act cum Additional District Judge, 5th Court at Berhampore, Murshidabad. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Murshidabad without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 638 of 2026 is allowed. Report subsequently submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
