2. Mr. G.S. Sandhu, learned Addl. Advocate General with Mr. Himanshu Sain, learned AGA for the State.

Present applicant has filed the instant application under Section C528 of BNSS, 2023 along with the exemption application seeking exemption to file affidavit since he is in jail in relation to Special Sessions Trial No. 9 of 2022 arising out of FIR No. 01 of 2022 wherein the applicant is facing the trial for the offence punishable under Section 2 / 3 of the U.P. Gangster and Anti Social Activities (Prevention) Act. By this petition the applicant challenging the
judgment and order dated 25.05.2026 passed by Special Sessions Judge / 2nd Addl. Sessions Judge, Nainital whereby the trial court refused to grant 15 days time to produce sureties.
4. Appellant, herein, was granted bail by the Coordinate Bench on 20.04.2026 on executing his personal bond and two sureties each of the like amount.

It is submitted by the learned counsel for the appellant that appellant could not arrange the two sureties, as ordered by the Coordinate Bench while granting bail, therefore, the appellant be released on bail in compliance of the order of the Coordinate Bench on personal bond with the condition that within 15 days, he will furnish two

sureties.
6. Mr. G.S. Sandhu, learned Addl. Advocate General has no objection to it, however, he submits that some rider may be imposed that if appellant fails to produce sureties within 15 days after his release, he will surrender before the court concerned.
7. After taking into
consideration the
submissions of the learned counsel for the parties,
order dated 20.04.2026 passed by the Coordinate Bench is modified to the extent that appellant shall be released on executing his personal bond of Rs. 50,000/- and after being released on bail, he shall furnish two sureties within 15 days, in terms of
order dated 20.04.2026 passed by the trial court and if he fails to furnish two sureties, he shall surrender before the trial court, immediately on expiry of 15 days from the date of release.
8. The instant C528 application stands
disposed of finally in above term.
