2. Present applicant-Arvind Sharma, S/o Sri Jagat Roop Sharma is challenging the proceeding of Complaint Case No.136 of 2026 under Section 138 of N.I. Act.
3. It is contended by learned counsel for the applicant that non-bailable-warrant has been issued against the applicant as well as the proceeding under Section 84 of BNSS, 2023 have also been initiated.

Learned counsel for the applicant submits that applicant is ready to face the trial court proceeding and will ensure his presence on the next date fixed before the trial court however, the non-bailabla-warrant as well as the proceeding under Section 84 of BNSS, 2023 may be suspended.
5. Since the applicant is ready to face the trial court proceeding, therefore, in such an eventuality, the non-bailable-warrant as well as the proceeding initiated under Section 84 of the BNSS, 2023 are kept in abeyance.
6. It is made clear that if the applicant is failed to ensure his presence before the trial court on the next date fixed, the non-bailable
warrant as well as the proceeding under Section 84 of the BNSS, 2023 shall automatically be revived.
7. Subject to the observation and direction above, the present C528 application is
disposed of finally.
