JUSTICE M.G.S. KAMAL ORAL ORDER The petitioner is before this Court seeking following reliefs. "a) Issue a writ of Mandamus directing the KIADB to consider representations of the Petitioner dated 25/11/2021 bearing No.DIPL/PKM/002/2021 - 22 (Annexure A1), dated, 22/02/2022 bearing No. DIPL/PKM/003/2021-22 (Annexure A2), dated 19/05/2022 bearing No. DIPL/PKM/001/2022-23 (Annexure A3) and dated 20/06/2022 bearing No. DIPL/PKM/002/2022-23 (Annexure A4) produced at Annexure A1, A2, A3 & A4 respectively; b) Issue a Writ of Mandamus directing KIADB to issue Demand Notice along with the plot numbers and sketch of the lands allotted to the Petitioner; - 3 - HC-KAR NC: 2026:KHC:9842 WP No. 25564 of 2022 c) Issue any other order as deems fit to the facts and circumstances of the case and to meet the interest of justice." 2. It is the case of the petitioner that, upon approval of the project proposal by the 'State Level Single Window Clearance Committee' (SLSWCC) for establishment of a 'Warehouse, Logistics and Industrial Infrastructure' project, a recommendation was made for the allotment of an extent of 50 acres of land at Dobaspet 5th Phase Industrial Area, Tumkur Road, Bangalore Rural District, Bangalore. The same was communicated to the petitioner vide letter dated 29.05.2021, as per Annexure-E. Thereafter, by communication dated 04.10.2021, produced as Annexure-H, the petitioner addressed the KIADB and requested issuance of the demand note along with the details of the land allotted to them. 3. In furtherance thereof, by communication dated 22.10.2021, KIADB issued a demand note calling upon the petitioner to pay the tentative cost for 50 acres of land at Rs.139.00 lakhs per acre plus 5% extra charges (up to 5 acres). The initial deposit of 30%, as required to be paid in terms of the demand note, was Rs.20,97,92,500/-. - 4 - HC-KAR NC: 2026:KHC:9842 WP No. 25564 of 2022 4. The petitioner is before this Court seeking a direction to the respondent–KIADB to consider his representation dated 25.11.2022, wherein the petitioner had requested the respondent–KIADB to provide the details of the land so as to enable him to make the payment. 5. The learned counsel for the petitioner, taking this Court through the records, submits that since the respondent– KIADB has not even shown/furnished the details of the 50 acres of land proposed to be allotted, the demand raised vide communication dated 22.10.2021 could not be complied with. It is contended that the bare minimum the petitioner is expected to know is the particulars of the land for which he is required to make the payment. 6. Pursuant to the direction of this Court, the respondent–KIADB has furnished a memo dated 18.02.2026 along with a sketch, providing the details of the land identified for allotment to the petitioner, in Plot No. 1B1 of Dobaspet 5th Phase Industrial Area, Tumkur Road, Bangalore Rural District, Bangalore. - 5 - HC-KAR NC: 2026:KHC:9842 WP No. 25564 of 2022 7. The learned counsel for the petitioner has also filed a memo along with a copy of the solvency certificate issued by Federal Bank, indicating the petitioner’s readiness and willingness to make the payment as demanded by the respondent. 8. In that view of the matter, following: ORDER (i). The writ petition is allowed. (ii). The respondent–KIADB is directed to consider the representation of the petitioner and pass appropriate orders in accordance with law within an outer limit of 30 days from the date of receipt of a certified copy of this order.
