The petitioners are apprehending their arrest in connection with Deoghar Town P.S. Case No.644 of 2021, for offence registered under section 188, 406, 420, 447 and 120-B of the IPC, pending in court of learned Chief Judicial Magistrate, Deoghar.

Learned counsel for the petitioners submits that the petitioner no.1 has been convicted and sentenced to RI for seven years by the learned Special Court, PMLA, Ranchi vide judgment dated 30.01.2017 and he has been granted bail in Cr.Appeal (SJ) No.423 of 2017 by the High Court and the petitioner no.2 happened to be owner of the said property and the allegations are made that said property in spite of confiscation is being used by the petitioner and the petitioners are also taking rent from the said property.

4. Learned State counsel opposes prayer and submits that allegations are there of confiscated property is being still used by the petitioners.

Considering that the property in question has already been confiscated and Enforcement Directorate is to take possession of the same and how the said property is being used by the petitioners in spite of confiscation that is the subject matter of investigation and investigation is still going on and it has been pointed out that the petitioners will cooperate in the investigation, and in that view of the matter, both the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper.
6. This petition is disposed of.
