Mr. Dushyant Mainali, Advocate, has put in appearance on behalf of private respondents. 4. By means of this writ petition, petitioners have sought the following relief:- “Issue a writ order or direction in the nature of mandamus directing the respondent no. 1 to initiate and hold the disciplinary proceedings/enquiry against the respondent no. 3 and 4 for their misconduct and suitably punish them in terms of provisions contained in Government Servant (Discipline and Appeal) Rules, 2003 as amended in 2010 and until such time the disciplinary proceedings/enquiry would be concluded against the respondent no. 3 and 4, they may be transferred outside the Kumaon Mandal so that they may not influence the disciplinary proceedings and temper with the evidence against them.” 5. Learned State Counsel points out that fair price shop license granted to petitioners was suspended, on account of irregularities, therefore, they have turned inimical towards the authorities, who passed the suspension order. She submits UKHC010120472026 2026:UHC:6080 that petitioners do not have any locus to seek the relief, as has been sought in the writ petition. 6. This Court finds substance in the said submission. 7. Even otherwise also, a Division Bench of this Court in WPPIL/19/2025 has dealt with similar prayer against the officers, who are impleaded as respondent nos. 3 & 4 in this writ petition. The said writ petition was disposed of by directing the Secretary of the concerned department to look into the complaint made by petitioner in that writ petition. 8. Learned State Counsel has produced in court the order passed by Principal Secretary, Food and Civil Supplies on 28.07.2025, in terms of order passed in WPPIL/19/2025. In his order, Principal Secretary has observed that if petitioner has any substance to support his complaint, then he can produce evidence against the officers concerned. 9. Since State Government has already dealt with the complaint against the officers, who are impleaded as respondent nos. 3 & 4, therefore, this Court is not inclined to pass any order in this writ petition. 10. Accordingly, the writ petition fails and is dismissed.
