ORAL ORDER Petitioners – accused Nos.1 to 3 are before this Court calling in question registration of a crime in Crime No.244/2023, pending before the 30th Additional Chief Judicial Magistrate, Bengaluru, for the offences punishable under Sections 420, 463, 464, 468, 471, 120B r/w. 34 of the IPC.

2. Heard Sri Chidananda P., learned counsel appearing for the petitioners, Sri Channappa Earappa, learned High Court Government Pleader appearing for respondent No.1, Sri S. Balaraju, learned counsel appearing for respondent No.2.

Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed a joint memo before this Court to this effect seeking permission for compounding of offences.
4. The joint memo reads as follows:
“The Petitioner and the Respondent No.2 herein humbly submit that due to the comprehensive dispute between the parties being amicably settled, in an Arbitration matter by filing the compromise petition and the award being drawn accordingly, the Respondent No.2 does not intend to prosecute the complaint registered as Cr. No.244/2023 before the Kumaraswamy Layout Police Station for the offences under Section 420, 463, 464, 468, 471, 120B r/w 34 of IPC, 1860. In view of the same the Respondent No.2 has no objection for setting aside of the said complaint in Cr. No.244/2023 pending on the file of 30TH Addl. Chief Judicial Magistrate, Bengaluru.
Wherefore, it is humbly prayed that this Hon'ble Court may be pleased to allow the above petition and consequently quash the FIR in Crime no.244/2023, Kumaraswamy Layout Police Station dated 28-07-2023,

pending on the file 30th Addl.Chief Judicial Magistrate, Bengaluru in the interest of justice and equity.”
In the light of the afore-quoted joint memo of the parties, as the dispute is between the individuals and the allegations are not against the State, I deem it appropriate to terminate the proceedings against the petitioners in the subject petition.
5. For the aforesaid reasons, the following:
O R D E R (a) The criminal petition is disposed. (b) The impugned crime in Crime No.244/2023 pending before the 30th Additional Chief Judicial Magistrate, Bengaluru, qua the petitioners, stands quashed.
