JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 18.06.2026 Heard Mr. A M Bora, the learned Senior Counsel assisted by Mr. D K Baidya appearing for the petitioner. Also heard Mr. M P Goswami, the learned Additional Public Prosecutor appearing for the State of Assam, Mr. S Das, the learned Amicus Curiae appearing for the respondent No.2 and Ms. S Saikia, the learned counsel appearing for the respondent No.3. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Sri Subhrajyoti Sarmah has prayed for releasing him on bail, after he was arrested in connection with Tezpur P.S. Case No.252/2026 (corresponding to G R Case No.603/2026) registered under Sections 74/75(2) of the BNS, 2023. 3. The respondent No.3 Smt. Ranjita Das had lodged an FIR before police alleging that the daughter of the informant and another girl were inappropriately touched by the teacher of the school i.e. the present petitioner. 4. Today, Ms. Saikia has submitted that she has no objection if bail is granted to the present petitioner. 5. Mr. S Das as well as Mr. M P Goswami have submitted that since the charge sheet has been filed, both the girls (victims) should be examined by the Trial Court. 6. I have considered the submissions made by the learned counsels of both sides. 7. Apart from the allegation that the girls were inappropriately touched by the teacher of the school, there are no allegation against the present petitioner. Therefore, the Bail Application filed by the petitioner is allowed. 8. Considering the aforesaid circumstances, this Court is of the opinion that the petitioner Sri Subhrajyoti Sarmah, who was arrested in connection with Tezpur P.S. Case No.252/2026, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Special Judge (POCSO), Sonitpur, Tezpur.
