This Cr.M.P. has been filed with the prayer to direct the appropriate authority to refund/release the surety amount of Rs.1,00,000/- (Rupees One Lakh Only) deposited by the petitioner in compliance with the order dated 02.11.2023 passed in A.B.A. No.9042 of 2023. Learned counsel for the petitioner submits that the petitioner was granted anticipatory bail in connection with Complaint (PCR) Case No.2236 of 2023 and in the said case, the petitioner was granted anticipatory bail subject to deposit of Rs.1,00,000/- (Rupees One Lakh Only) as Cash Security and the petitioner deposited the same. It is next submitted that the said complaint case ended up in acquittal of the petitioner, but the learned Judicial Magistrate, First Class, Dumka has not released the said amount deposited by the petitioner in the said complaint case, hence, the prayer as prayed for by the petitioner in this Cr.M.P., be allowed. Learned Addl.P.P. appearing for the State has no objection. Considering the aforesaid facts, the learned Judicial Magistrate, First Class, Dumka is directed to release Rs.1,00,000/- (Rupees One Lakh Only) deposited as Cash Security to the petitioner forthwith by passing the appropriate orders.
