(2) By means of this writ petition, petitioners have sought the following reliefs:
“I) Issue a writ, order, or direction in the nature of certiorari to set aside the order dated 07.05.2026 passed by the District Judge, Haridwar, in Misc. Civil Appeal No. 67 of 2025 titled as “Rajesh Sharma v. Narendra Sharma” (Annexure No. 1, page no. 17-18 of the writ petition).
II) Issue a writ, order, or direction to the parties to maintain status quo with regards to the suit property in Misc. Civil Appeal No. 67 of 2025 titled as “Rajesh Sharma v. Narendra Shram”.”
(3) Mr. Deepak Bhatt, learned Counsel appearing for the respondent, points out that respondent had filed a suit for mandatory injunction against the petitioners and learned Trial Court returned a finding that respondent is the sole owner of the land in question. He submits that the partition suit filed by petitioners qua the said land is not maintainable, as petitioners do not have any semblance of right, title or interest over that land.

2026:UHC:6052 petitioners then submits that the judgment and decree passed in the suit for mandatory injunction is challenged in an appeal, which is pending before District Judge, Haridwar.
(5) The impugned order is passed in a miscellaneous appeal, filed by petitioners against an interlocutory order passed in a suit for partition. By the impugned order, interim relief granted in favour of petitioners earlier was recalled.
(6) After arguing for a while, learned Counsel for the petitioners seeks permission to withdraw the writ petition at this stage. Writ petition is, accordingly, dismissed as withdrawn.
