Ms. Pampa Dey (Dhabal) Ms. Sangita Banerjee ….for the petitioner Mr. Chandi Charan De, AGP Mr. Anirban Sarkar ….for the State The learned advocate appearing for the petitioner submits that the respondent authorities including the railway authorities have been duly served. She prays for leave to file the affidavit of service in course of this day. In spite of service, none appears for the railway authority. The petitioner alleges that the plots of land owned and recorded in the name of the petitioner has been utilised by the railway authorities for the purpose of laying railway tracks, but no compensation has been paid by the railways authorities to the petitioner till date. The petitioner submitted a representation dated February 19, 2026 before various authorities including the Divisional Railway Manager, South Eastern Railway. Without entering into the merits of the claim made in the said representation, WPA 7090 of 2026 stands disposed of by directing the Divisional Railway Manager, South Eastern Railway, being the respondent No.8 to 2 consider the representation of the petitioner dated February 19, 2026 and to dispose of by passing a reasoned order after affording an opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation dated February 19, 2026. If the said respondent authority is of the view that the issue raised in the representation does not fall within his jurisdiction, he shall forward the same to the competent authority, who shall upon receipt of the same pass a reasoned order on the said representation within the time limit mentioned hereinbefore.
