The petitioner has filed the present petition as a public interest litigation, inter alia, seeking the following reliefs: "a) Issue a writ of mandamus or any other appropriate writ or direction, directing the respondent Nos.2 and 3 not to grant any piece of land either to Municipality of Nagamangala or any other person in Survey No.112 of Thuppadamadu village, Kasaba hobli, Nagamangala Taluk, Mandya District; b) Issue a writ of mandamus or any appropriate writ or direction directing the respondent to take necessary steps to evict some of the unauthorised occupant in Survey No.112 of Thuppadamadu village, Kasaba hobli, Nagamangala Taluk, Mandya District; c) Grant such other relief or relief as the Hon'ble Court deems it fit to grant in the facts and circumstances of the case and in the interest of justice and equity." 2. The petitioners state that they become aware that 9 acres 21 guntas of land falling in Survey No.112 of Thuppadamadu Village, Kasaba hobli, Nagamangala Taluk, Mandya District, is sought to be marked for distribution of sites by the City Municipal Council, Nagamangala. It is the petitioners' case that the said land falls within 5 kilometers of the Municipality limits of Nagamangala and therefore granting of such land is illegal. - 5 - HC-KAR NC: 2026:KHC:8537-DB WP No. 38933 of 2025 3. This Court had called upon the learned counsel for the petitioners to refer to the statutory provisions proscribing the grant of land within five kilometers of the Municipal limits. He has now referred to Section 94-C of the Karnataka Land Revenue Act, 1964 in support of the said contention. A plain reading of the said Section indicates that the same concerns regularisation of unauthorised occupation. The same has no application for allotment of lands to homeless persons under the 'Ashraya' scheme. 4. In view of above, we do not consider it apposite to entertain the present petition.
