Heard Mr. Rishab Ranghar, learned counsel for the applicant and Mr. Vikas Bahuguna, learned counsel for the respondent. 2. The Transfer Application No. 255 of 2026, Shravan Kumar Gupta vs. Sarita Gupta was filed by the applicant before the learned District Judge, Dehradun. While the said application was moved, the applicant had prayed for transfer of the SCC Suit No.14 of 2024 pending before the IInd Additional District Judge, Dehradun to the Court of Ist Additional District Judge, Dehradun. The said application was filed on 19.05.2026. The applicant thereafter filed the transfer application before this Court on the ground that the court of learned District Judge was vacant. This Court vide order dated 03.07.2026 passed an interim order, by which, it was provided that, in case, an application seeking adjournment is moved by learned counsel for the applicant before the trial court, the same shall be considered for granting adjournment till the next date of listing. Learned counsel for the respondent has submitted that now the District Judge, Dehradun has taken charge and the application filed by the applicant can be considered by the said court. 4. The said fact is not disputed by the learned counsel for the applicant. 5. It is submitted that the said Transfer Application No. 255 of 2026, is listed before the District Judge on 24.07.2026. Hence, the court of learned District Judge may be directed to decide the same at the earliest. 6. In that view of the matter, the present transfer application has become infructuous and the same is dismissed. However, learned District Judge shall consider and decide the Transfer Application No.255 of 2026, Shravan Kumar Gupta vs. Sarita Gupta, on its own merit. 7.
