No.18767 of 2026 ORDER: The writ petition is filed under Article 226 of the Constitution of India, to issue a writ or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondents Nos. 2 to 4 in not taking any action against the online application bearing No.RMU012107177911, dated 30.07.2021, given by the petitioner to the respondents Nos.2 to 4 through Mee- seva, for mutation of title and issue e-pass book with regarding to the land succeeded by the petitioner to an extent of Ac. 2.90 cents in Sy.No. 341, with khata No. 695, situated at Somayajulapalle Village, Orvakal Mandal, Kurnool District, Andhra Pradesh State, as illegal, arbitrary and contrary to the Provisions of the Andhra Pradesh (Rights in Land) and Pattadar Pass Books Act, 1971 and also violation of Article 21 and 300-A of the Constitution of India and also against the principles of natural justice; and consequently, to direct the respondents Nos. 2 to 4 to mutate title and issue e-pass book with regarding to the subject land in favour of the petitioner and to pass such other order as the Court deems fit. 2. Sri G. Divyatheja, learned Assistant Government Pleader for Revenue, placed on record a copy of written instructions of the respondent No. 4 vide Rc.A / 18 / 2026, dated 21.07.2026, wherein it is stated as below: The lands in Sy.No. 341 to an extent of Ac. 6.86 cents of Somayajulapalli Village is patta land as per resurvey and resettlement register of Somayajulapalli Village. The writ petitioner purchased the land in Sy.No. 341, Ac. 5.80 from Syyed Hudayatulla Khadri. The writ petitioner applied for mutation in the year 2021. Munipati 3 BSB,J W.P. No.18767 of 2026 Shikhamani and his sons who were enjoying the land in Sy.No. 341 objected for mutation and informed that they had never sold the land to anybody and that the writ petitioner and his sellers had fabricated the documents. Hence, the mutation could not be processed. The writ petitioner filed O.S. No. 1366 of 2023 on the file of the Court of the Principal Civil Judge (Junior Division), Kurnool, against M.Chinna Buggana. If the writ petitioner applies in meeseva in Form-VI for muatation by entering his name, a notice for objection in Form-VIII will be issued to the concerned and further action will be taken as per procedure in the R.O.R. Act. 3. In view of the written instructions, the learned counsel for the petitioner requested to dispose of the writ petition by recording the written instructions and granting liberty to the petitioner to act accordingly. 4. As such, the writ petition is disposed of recording the written instructions as part of the order and further granting the petitioner liberty to make an application afresh in Mee Seva in Form – VI as required under law.
