2026:JHHC:5899 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 539 of 2026 Kamlesh Kumar @ Kamlesh Kumar Yadav, S/o Chhotak Singh, R/o Paryavaran Nagar, Opposite L.N. Mishra Colony, PO-Hehal, PS-Pandra O.P., District-Ranchi … … Petitioner Versus The State of Jharkhand … … Opposite Party CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Ranjit Kumar Tiwari, Advocate For the State : Ms. Sushma Aind, A.P.P. ----- 02/27.02.2026 Heard learned counsel for the parties. 2. The petitioner is an accused for the offence punishable under Section 379 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The allegation against the petitioner is that he committed theft of an autorickshaw (Tempo) bearing registration No. JH-01-DL-8994 owned by Nawal Kishore Thakur which had been given to the informant on rent. In fact, a negotiation was going on between the informant and the petitioner for sale of the said autorickshaw. The petitioner did not have any intention to commit theft of the said autorickshaw, rather he has been implicated in the present case by the informant due to grudge and previous enmity. The petitioner has been remanded in this case on 20.06.2025 and since then, he is in judicial custody. At least considering the length of judicial custody, he may be given the privilege of regular bail. 4. Learned A.P.P. opposes the petitioner’s prayer for bail. 5. Having heard learned counsel for the parties and considering that the petitioner is in judicial custody since 20.06.2025, I am inclined to enlarge him on bail. Accordingly, the petitioner above named is directed 2026:JHHC:5899 2 to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ranchi in connection with Sukhdeonagar (Pandra O.P.) P.S. Case No. 72 of 2023. (Rajesh Shankar, J.) February 27, 2026 Manish Uploaded on 27.02.2026
